The regular meeting of the Village of Falconer Mayor and Board of Trustees was held on Tuesday, November 12, 2019 at 7:00 P.M. in the Community Building Board Room with Mayor James Rensel presiding.
Visitor
Patrick Bull, 68 E. Everett, requested the board consider alternate parking law for some village streets such as E. and W. Everett. Mr. Bull stated that the increased number of multiple-apartment dwellings have in turn, increased the number of cars parking on village streets, resulting in what Mr. Bull believes, are difficulties with leaf pick-up and winter plowing.
Joseph Taylor, 25 E, Falconer Street, Falconer, NY, Lisa Piazza, Alan Gustafson Jr., 105 W. James Street, and Eric Tichy of the Post-Journal were all in attendance to observe the proceedings.
Minutes
Trustee Dunn made a motion, seconded by Trustee Steele, to approve the minutes of October 15, 2019 as written. Ayes: Dunn, Steele, Jaroszynski, Catanese, and Rensel. Carried.
Fire Chief
The chief’s October report was reviewed and noted that the department responded to 62 EMS, 3 Carbon Monoxide, 3 Standby, 8 Alarms, 1 Water Evacuation, 1 Weather, and 1 Rubbish Fire, totaling 79 calls. 475.13 personnel hours in September.

- Given: Frewsburg 4, Gerry 1, Jamestown 14, Panama 2
Trustee Steele made a motion, seconded by Trustee Dunn, to accept Madeline Lines of Waldemeere Avenue, Falconer, NY, as a member of the Falconer Fire Department Hose Company upon her successful completion of the NYS required human resource trainings. All required background checks and physicals have been completed satisfactorily. Ayes: Dunn, Steele, Jaroszynski, Catanese and Rensel. Carried.
Joe Taylor spoke from the floor and asked for an update on his October request for the Falconer Fire Department Bi-Laws to be made public. Trustee Steele stated that he would follow up on Mr. Taylor’s request.
Code Enforcement Office
Mr. Gustafson was in attendance to provide the Board with a verbal code report for October stating:
- 1 Demo Permit/Asbestos Abatement Complete-Powell Building, W. Main Street
- Large amount of Garbage Cleaned up-Dow Street
- Home Leasing Site Plan review is scheduled for Wednesday, November 20th at 6 pm in the Library.
- Santa Parade has been scheduled for November 23rd at 1 pm. Mayor and & Board invited to participate.
- Rotary Breakfast, Saturday, November 16th 7:30-10:30 am at Falcon’s Nest.
Department of Public Works
The DPW report was reviewed for the period October 14-November 10, 2019.
Library
The October library report was reviewed. This month the library received $23.98 for fines, $107.12 for copies and faxes, $62.00 basket sale, $1,590.00 for gifts & donations.
Mrs. Becker reported that several patrons expressed concern that the village did not “do enough” for Sue Seamans when she retired. A suggestion was made to name the alley-way next to the library, Sue Seaman’s Drive. Mrs. Becker said she has explained to the patron’s that Sue’s wish was to “go out quietly without recognition, however, Mrs. Becker felt the board should be made aware of the patrons concerns.
Mrs. Becker reported that she had been contacted by the Falconer Legion in regards to the Legion taking over the Memorial Day parade.
Committees:
Legal
Mr. Peterson asked for an executive session following the open meeting to discuss current litigation matters. In another matter, the US vs Whitehill case was signed off by the Federal Court and completed. Mr. Peterson reminded the board that the case can be opened in NY Court by Mr. Whitehill.
Animal Control:
The October animal control reports were reviewed. Several complaints were received and followed up.
Finance:
Treasurer Trask reported that the school’s 50% portion of crossing guard’s salary plus FICA will be billed to the school in June as a one-time payment for the entire 2019/2020 school year.
Mr. Trask also reported that sales tax increased 11.1% over the same quarter last year and the village has currently received 58.4% of its budgeted sales tax year to date which is a 10.51% increase YTD vs the prior year.
Correspondence:
A letter regarding the Goodwill cat situation was read to the board by Mayor Rensel.
Abstracts
Trustee Dunn made a motion, seconded by Trustee Steele that Abstract #6, General Fund in the amount of $31,179.58 be approved for payment. Ayes: Dunn, Steele, Jaroszynski, Catanese and Rensel. Carried.
Trustee Jaroszynski made a motion, seconded by Trustee Catanese, that Abstract #6, Cemetery Fund in the amount of $327.99 be approved for payment. Ayes: Dunn, Steele, Jaroszynski, Catanese and Rensel. Carried.
Trustee Catanese made a motion, seconded by Trustee Dunn, that Abstract #6, Library Fund in the amount of $1,843.97 be approved for payment. Ayes: Dunn, Steele, Jaroszynski, Catanese and Rensel. Carried.
Trustee Steele made a motion, seconded by Trustee Jaroszynski, that Abstract #6, General Fund Hand Items in the amount of $33,980.54 be approved for payment. Ayes: Dunn, Steele, Jaroszynski, Catanese and Rensel. Carried.
Motion to Adjourn to Executive Session
Trustee Steele made a motion, seconded by Trustee Dunn, to adjourn into Executive Session at 7:52 PM to discuss litigation matters. Ayes: Dunn, Steele, Jaroszynski, Catanese and Rensel. Carried.
